Beginning January 1, 2009, the IRS mileage reimbursement rate will be 55 cents per mile. For additional details, read the IRS news release. Keep in mind that most California state enforcement agencies consider the IRS rate the most reasonable.

As an employer if we pay a lesser mileage reimbursement rate than set by the IRS is the difference an uncompensated business expense to the employee and therefore be able to be written off on their taxes?

California considers the IRS rate the most reasonable rate. If you pay more or less, consult with legal counsel and your accountant for potential implications of doing so.
